Based on Defendant Bruce Ray Noyes' status report as requested by this Court, and considering that Defendants Noyes and Animal Pharmaceuticals Inc. (API) paid $150,000.00 into the Court's registry, which has been distributed to the victims thereby paying in full the restitution owing to thirteen (13) claimants and reducing the restitution amounts of the three (3) remaining claimants, and considering the recent severe global economic downturn, the Court is considering modifying the restitution payment schedule as follows:

1. In February 2009, Defendant Noyes shall pay into the Court's registry the sum of $50,000.00 from monies held back by Lextron that will be paid to him on or about January 30, 2009; 2. That $50,000.00 will be distributed pro rata to the three (3) remaining claimants; 3. Defendants' payments of $3,000.00 per month will be delayed until September 1, 2010, when they will resume and continue on the first of each month thereafter until August 31, 2011; on September 1, 2011, the payments will increase to $5,000.00 per month and continue on the first of each month until August 31, 2013, when they will increase to $8,000.00 per month and continue on the first of each month until restitution is paid in full.

The Clerk's Office will send a copy of this proposed modification to the three (3) remaining claimants who may submit comments no later than November 7, 2008. No later than November 14, 2008, the United States Attorney's Office may submit comments on this proposed modification. Defendants Noyes and API may reply to those submissions no later than November 21, 2008. The Court will consider those filings, if any, without a hearing and will enter a modified restitution order.
