05/14/2007	45	Order: This matter is before the Court upon the Defendants' Motion in Limine (Doc. 41 ) in which defendants ask that the Court prohibit the government from introducing evidence regarding defendant Mark C. Olds's prior felony convictions. The government opposes the motion. Upon review, the Court concludes that the government may introduce evidence of the prior felony convictions under principles of res gestae. Introduction of the fact of conviction is necessary to properly portray the relationship between the various entities and the school, as well as the reason why certain entities were formed in the first place. The government, however, correctly concedes that the nature of the convictions, the sentences received or the facts supporting the charges are inadmissible. Although the government may introduce the fact of conviction for purposes of its case-in-chief, the government may not cross-examine Mr. Olds regarding the convictions for purposes of impeachment. The convictions are greater than ten years old and the government fails to demonstrate exceptional circumstances sufficient to warrant admission of the evidence. The parties also dispute whether defendants should be permitted to cross-examine Mr. Daniels regarding the dismissal of the indictment filed against him. Mr. Daniels was initially indicted along with the remaining defendants, but was subsequently dismissed by the government. The government avers that it made no promises in exchange for Daniels's dismissal and, accordingly, the evidence should not be admitted. This Court disagrees. Mr. Daniels made statements to the government while under indictment. As defendants point out, at the time the statements were made, Mr. Daniels may have had a vested interest in inculpating the defendants so as to exculpate himself. The timing of the events leading to the dismissal of the indictment, even absent an agreement to cooperate, is relevant to show bias on the part of Mr. Daniels.
