The Government filed the application, but did not include any supporting affidavit as is explicitly required by the statute. Additionally, the statute requires the Government's application to "state that the debtor against whom the prejudgment remedy is sought shall be afforded an opportunity for hearing." § 3101(a)(3)(A). Though the instant application failed to make any such provision, the Court notes that if the Government seeks to re-file its application, such a hearing is required by statute.
