Booker, 2004 WL 1535858 (7th Cir. 2004) and/or United States v. Fanfan, No. 03-47-P-H (D.Me. June 28, 2004) or November 29, 2004. Defendant's bond shall remain in effect during that period and he shall fully comply with the terms of bail that were previously set. Either party may request a modification of this order after those decisions are issued. The Government's well-written Opposition to Defendant's Ex Parte Application for Bail Pending Appeal minimizes the possiblity that the Supreme Court will wholly invalidate the sentencing guidelines. That may not be a probable outcome, but it is far from inconceivable. Given the huge uncertainty in the law of sentencing that currently prevails, Defendant's arguments do raise a substantial question of law. Contrary to the Government's contentions, moreover, the Defendant has established, by clear and convincing evidence, that he is not likely to flee or pose a danger to the community.
