On or about 8/00 through 4/01; the exact dates being unknown to the
Grand Jury, within the Northern District of NY, and elsewhere, the defts
together with others both known and unknown to the grand jury, did
knowingly conspire and agree together to violate the Clean Air Act and
the Comprehensive, Environmental Response, Compensation & Liability
Act (CERCLA) or Superfund related to asbestos abatement and disposal at
facilities belonging to the Plattsburg Housing Authority; to accomplish
the conspiracy, co-conspirators would remove asbestos without complying
with each of the requirements; would dispose of asbests illegally in
non-permitted locations throughout Plattsburg, NY, and thereafter not
immediately report the release of this asbestos to the National Response
Center as required by law; effectuate the conspiracy, co-conspirators
performed one or more of the following overt acts with the Northern
District of NY: deft Andre Parker held himself out as having a Master's
Degree and a PhD when he merely purchase these degrees from a mail order
school; co-conspirators failed to notify the US EPA at least 10 days
prior to the start of the 8/00 and 3/01 Plattsburg Housing Auth.
asbestos abatements; co-conspirators stripped asbestos w/o first
adequately wetting it; co-conspirators removed asbestos w/o properly
bagging it; co-conspirators disposed of asbestos by dumping at
non-permitted locations; co-conspirators did not immediately report the
release to the Nat. Resp. Ctr., in (1) |
