The Court has also read in full Rule 38(e) of the Federal Rules of Criminal Procedure. The Court respectfully disagrees with the Government's reading of Rule 38(e). Subsection (1) of that Rule allows the District Court or the Court of Appeals to stay a restitution order if a Defendant appeals. Subsection (2) provides the Court with certain remedies to ensure compliance with restitution orders but only applies "after disposition on appeal".
