10/29/200354 EO : COURT ACTION ORDER DENYING DEFENDANT ANTHONY A. RUTLEDGE, SR.'S MOTION TO STRIKE SURPLUSAGE FROM SECOND SUPERSEDING INDICTMENT Defendant Anthony A. Rutledge, Sr. ("Defendant") having filed the Motion to Strike Surplusage from Second Superseding Indictment on October 6, 2003 ("Motion to Strike") and Reply Memorandum on October 21, 2003, and the United States of America ("United States") having filed its Memorandum in Opposition on October 17, 2003, and this matter having come on for hearing on October 27, 2003, for the reasons set forth below, the Court hereby DENIES the Motion to Strike. Defendant seeks to strike thirteen paragraphs of Count I of the Indictment against him. (Def.'s Mot. at 1; App. at 1-5.) He argues that these allegations "have no relevance, no legitimate purpose, and are indeed an attempt by the government to end run Federal Rule of Evidence 404(b) and place prejudicial but irrelevant material before the jury." (Def.'s Reply at 2-3.) Rule 7(d) of the Federal Rules of Criminal Procedure states that "[t]he court on motion of the defendant may strike the surplusage from the indictment or information." Fed. R. Crim. P. 7(d). "The purpose of a motion to strike under [Rule] 7(d) is to protect a defendant against prejudicial or inflammatory allegations that are neither relevant nor material to the charges.'" United States v. Terrigno, 838 F.2d 371, 373 (9th Cir. 1988) (quoting United States v. Ramirez, 710 F.2d 535, 544-45 (9th Cir. 1983)). In Terrigno, the defendant was charged with the crime of embezzlement and conversion of public funds. She objected to the allegations in the indictment which characterized her allegedly unlawful behavior as embezzling funds that were for the "poor and homeless," that she issued checks "willfully," and that she attempted to "lull and deceive" the charitable organization which held the public funds. See id. The United States Court of Appeals for the Ninth Circuit concluded that the district court did not abuse its discretion. The facts are similar here. The indictment contains language about Defendant's alleged acts in participating in the conspiracy, in particular, his alleged attempts to conceal his participation. While the language is less than complimentary about Defendant, it is related to the charges against him and other Defendants. Defendant's motion to strike is therefore DENIED. IT IS SO ORDERED.
